A working draft of the Cybersecurity Act of 2009 is available in PDF format. I have not read through the entire thing yet, but what I have read so far is raising some red flags about Internet regulation.
For instance, there is some discussion toward the end of the document about private-public data sharing. The act, as drafted, gives the United States Commerce Department various powers and duties in Section 14. The Commerce Department …
…shall have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule or policy restricting such access. [emphasis added]
This basically says that privacy law does not matter.
The act also gives the president the ability to “declare a cybersecurity emergency” and shut down or limit Internet traffic in any “critical” information network “in the interest of national security.”
Here’s the problem. Neither the critical information network nor the cybersecurity emergency are defined. This would be determined by the president.
